Ukraine\u2019s truly epic resistance to Russia’s unprecedented brutal aggression has entered its second month. The war that Ukraine was forced to wage has rallied the entire nation.<\/p>\n\n\n\n

L'esercito sta annientando gli invasori sul campo di battaglia; l'economia lavora al limite ovunque le circostanze lo consentano; i volontari hanno assunto molte funzioni dello Stato che quest'ultimo, in questi giorni, semplicemente non \u00e8 in grado di svolgere; i chirurghi trascorrono intere giornate nelle sale operatorie, quasi senza riposo, per salvare vite, mentre i soccorritori affrontano le conseguenze dei bombardamenti e dei cannoneggiamenti.<\/p>\n\n\n\n

In tutta l'Ucraina, persino nelle zone di combattimento delle regioni di Kherson, Zaporizhzhia e Mykolaiv, \u00e8 stata avviata la campagna di semina, cosa forse difficile da immaginare per chi vive in Paesi lontani da questa guerra. Eppure \u00e8 cos\u00ec!<\/p>\n\n\n\n

Senza peccare di eccessiva presunzione, si pu\u00f2 affermare che la stragrande maggioranza degli ucraini, sia nel Paese sia nel resto del mondo, aiuta la propria patria in ogni modo possibile, avvicinando la vittoria.<\/p>\n\n\n\n

Oggi \u00e8 gi\u00e0 evidente che l'intero mondo civile \u00e8 dalla parte dell'Ucraina. Il Paese riceve aiuti umanitari e molte nazioni accolgono milioni di donne e bambini in fuga dalle zone di guerra. Migliaia di manifestazioni a sostegno dell'Ucraina si svolgono nelle citt\u00e0 di tutta Europa, degli Stati Uniti, del Canada e del Giappone.<\/p>\n\n\n\n

Va rilevato che molti governi, nel loro sostegno all'Ucraina, vanno oltre gli aiuti umanitari, fornendo all'Ucraina vari tipi di armi letali difensive. Ma la situazione si sta evolvendo in modo tale che persino questa assistenza non basta.<\/p>\n\n\n\n

Purtroppo, il mondo sembra restare prigioniero degli stereotipi percettivi sviluppatisi in tempo di pace. Spesso la coscienza delle persone si rifiuta semplicemente di vedere il vero volto della brutale realt\u00e0. Azioni adeguate ed efficaci sono ostacolate dal doppio pensiero, dalla mancanza di scrupoli e da ogni sorta di formalit\u00e0 conservatrici e procedure farraginose. Ci\u00f2 che \u00e8 essenziale per uno sviluppo di successo in tempo di pace diventa un enorme problema in tempo di guerra.<\/p>\n\n\n\n

It must be admitted that Russian experts in the field of information and psychological warfare had long been dissecting weaknesses of the collective “West,” seeing is as a future enemy, having ultimately found its most vulnerable spots. This, in turn, allowed Russia to develop a strategy to pursue alarmingly effective psyops, which, along with the military component, remain the most important striking force in the hybrid warfare doctrine.<\/p>\n\n\n\n

A simple, but unfortunately effective technique was “euphemization” of the concept of war, that is, replacing it with \u201cspecial military operation\u201d, which has driven into a dead end the efforts of legal experts, who for more than a month have been trying to find in international law an answer to the question: \u201cAre there legal signs of waging a war in Russia\u2019s actions, and are conventions and other sources of international law, in which the concept is used, applicable here in the first place?\u201d<\/p>\n\n\n\n

This is not the first time Russia has used this mind game technique. \u201cCoercion to peace\u201d in 2008 in Georgia, \u201cWe are not there\u201d in Crimea and Donbas in 2014, and \u201cinternational assistance to the fraternal Syrian people\u201d in Aleppo in 2021. And this is not an exhaustive list of “twisted reality” stunts performed by Russia. Unfortunately, the said technique remains effective. The judiciary in civilized countries has been \u201cmired\u201d in casuistry of international law, failing to prosecute perpetrators, let alone masterminds behind the crimes. In the current conditions, Russia is hinting at the assumption that there might be no case here at all! \u201cTry to prove that this is, in fact, a war! Try to prove the obvious!\u201d Russia dares the world.<\/p>\n\n\n\n

But what should be done in this situation? First of all, common sense must return to the law. This means that the obvious must be recognized without delay. Evidence must only be gathered to prove the non-obvious, which would rule out any abuse of law by Russia. Courts must hand down their judgments promptly and absolutely unambiguously, in order to avoid any possibility for Russia to gain a \u201cconvenient\u201d interpretation. The time has come for something beyond “refined,” perfectly crafted legal decisions. It\u2019s time for political legal decisions, too. All Russian masterminds and perpetrators of crimes must receive a signal: “None of your playbook methods work any longer so you will all be held accountable!”<\/p>\n\n\n\n

There is some progress to this end. On March 7, during hearings at the International Court of Justice on provisional measures in the “Ukraine v. Russia” case based on the Genocide Convention, Yale University Professor Harold Hongju Koh, who represented Ukraine\u2019s interests, outlined the country\u2019s position and the provisional measures the government has filed for. In his emotionally-driven speech, the most important thing was that a political argument was voiced regarding the long-term significance of the court ruling in this case for all international law and global legal order.<\/p>\n\n\n\n

Hongju Koh ha chiesto alla Corte di riconoscere che la Russia, membro permanente del Consiglio di sicurezza dell'ONU, ha deciso \u00abcon deliberata premeditazione di commettere un'aggressione palese e crimini di guerra, lanciando una vasta e brutale campagna militare contro un vicino innocente e la sua popolazione civile, con il falso pretesto che lo Stato preso di mira stia commettendo un genocidio\u00bb.<\/p>\n\n\n\n

“When confronted by such open illegality, is this Court utterly powerless to stop it?\u201d he added.<\/p>\n\n\n\n

Professor Hongju Koh stressed the importance of the Court’s precedent ruling, which should ignite a spark in the efforts of other international institutions dealing with Russian aggression, war crimes, and violations of human rights.<\/p>\n\n\n\n

Secondo il legale, si tratta di una controversia tra la Russia e l'ordine giuridico globale formatosi dopo la Seconda guerra mondiale. Se la Corte non si opporr\u00e0 con decisione alla Russia, ci\u00f2 confermer\u00e0 il crollo dell'ordine giuridico mondiale, nonch\u00e9 l'impotenza dell'ONU e della Corte internazionale di giustizia.<\/p>\n\n\n\n

Le argomentazioni addotte da un autorevole giurista non erano puramente giuridiche, ma anche politiche. Tuttavia, hanno funzionato. Ci\u00f2, a sua volta, crea un altro precedente.
