The war that Ukraine was forced to wage has rallied the entire nation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019arm\u00e9e an\u00e9antit les envahisseurs sur le champ de bataille, l\u2019\u00e9conomie fonctionne \u00e0 plein r\u00e9gime partout o\u00f9 les circonstances le permettent, les volontaires ont assum\u00e9 de nombreuses fonctions de l\u2019\u00c9tat que celui-ci est tout simplement incapable d\u2019exercer ces jours-ci, les chirurgiens passent des journ\u00e9es au bloc op\u00e9ratoire avec peu de repos afin de sauver des vies, tandis que les secouristes g\u00e8rent les cons\u00e9quences des bombardements et des tirs d\u2019artillerie.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans toute l\u2019Ukraine, y compris dans les zones d\u2019hostilit\u00e9s actives des r\u00e9gions de Kherson, de Zaporijjia et de Mykola\u00efv, la campagne de semis a \u00e9t\u00e9 lanc\u00e9e \u2014 ce qui est sans doute difficile \u00e0 imaginer pour qui vit dans des pays \u00e9loign\u00e9s de cette guerre. Et pourtant, c\u2019est vrai !<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sans nous vanter outre mesure, on peut affirmer que l\u2019immense majorit\u00e9 des Ukrainiens, tant dans le pays qu\u2019\u00e0 travers le monde, aident leur patrie de toutes les mani\u00e8res possibles, rapprochant ainsi la victoire.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il est d\u00e9j\u00e0 devenu \u00e9vident aujourd\u2019hui que tout le monde civilis\u00e9 se range aux c\u00f4t\u00e9s de l\u2019Ukraine. Le pays re\u00e7oit une aide humanitaire, et de nombreux \u00c9tats accueillent des millions de femmes et d\u2019enfants fuyant les zones de guerre. Des milliers de rassemblements de soutien \u00e0 l\u2019Ukraine se tiennent dans des villes d\u2019Europe, des \u00c9tats-Unis, du Canada et du Japon.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il convient de noter que de nombreux gouvernements vont au-del\u00e0 de l\u2019aide humanitaire dans leur soutien \u00e0 l\u2019Ukraine, en lui fournissant diverses armes l\u00e9tales \u00e0 vocation d\u00e9fensive. Mais la situation \u00e9volue de telle sorte que m\u00eame cette aide ne suffit pas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Malheureusement, le monde semble rester \u00ab prisonnier \u00bb des sch\u00e9mas de pens\u00e9e \u00e9labor\u00e9s en temps de paix. Souvent, la conscience des gens refuse tout simplement de voir le v\u00e9ritable visage de la r\u00e9alit\u00e9 brutale. Les actions ad\u00e9quates et efficaces sont entrav\u00e9es par la double pens\u00e9e, des scrupules mal plac\u00e9s et toutes sortes de formalit\u00e9s conservatrices et de proc\u00e9dures lourdes. Ce qui est essentiel \u00e0 un d\u00e9veloppement r\u00e9ussi en temps de paix devient un \u00e9norme probl\u00e8me en temps de guerre.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It must be admitted that Russian experts in the field of information and psychological warfare had long been dissecting weaknesses of the collective &#8220;West,&#8221; seeing is as a future enemy, having ultimately found its most vulnerable spots. This, in turn, allowed Russia to develop a strategy to pursue alarmingly effective psyops, which, along with the military component, remain the most important striking force in the hybrid warfare doctrine.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A simple, but unfortunately effective technique was &#8220;euphemization&#8221; of the concept of war, that is, replacing it with \u201cspecial military operation\u201d, which has driven into a dead end the efforts of legal experts, who for more than a month have been trying to find in international law an answer to the question: \u201cAre there legal signs of waging a war in Russia\u2019s actions, and are conventions and other sources of international law, in which the concept is used, applicable here in the first place?\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is not the first time Russia has used this mind game technique. \u201cCoercion to peace\u201d in 2008 in Georgia, \u201cWe are not there\u201d in Crimea and Donbas in 2014, and \u201cinternational assistance to the fraternal Syrian people\u201d in Aleppo in 2021. And this is not an exhaustive list of &#8220;twisted reality&#8221; stunts performed by Russia. Unfortunately, the said technique remains effective. The judiciary in civilized countries has been \u201cmired\u201d in casuistry of international law, failing to prosecute perpetrators, let alone masterminds behind the crimes. In the current conditions, Russia is hinting at the assumption that there might be no case here at all! \u201cTry to prove that this is, in fact, a war! Try to prove the obvious!\u201d Russia dares the world.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But what should be done in this situation? First of all, common sense must return to the law. This means that the obvious must be recognized without delay. Evidence must only be gathered to prove the non-obvious, which would rule out any abuse of law by Russia. Courts must hand down their judgments promptly and absolutely unambiguously, in order to avoid any possibility for Russia to gain a \u201cconvenient\u201d interpretation. The time has come for something beyond &#8220;refined,&#8221; perfectly crafted legal decisions. It\u2019s time for political legal decisions, too. All Russian masterminds and perpetrators of crimes must receive a signal: &#8220;None of your playbook methods work any longer so you will all be held accountable!&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is some progress to this end. On March 7, during hearings at the International Court of Justice on provisional measures in the &#8220;Ukraine v. Russia&#8221; case based on the Genocide Convention, Yale University Professor Harold Hongju Koh, who represented Ukraine\u2019s interests, outlined the country\u2019s position and the provisional measures the government has filed for. In his emotionally-driven speech, the most important thing was that a political argument was voiced regarding the long-term significance of the court ruling in this case for all international law and global legal order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hongju Koh a demand\u00e9 \u00e0 la Cour de reconna\u00eetre que la Russie, membre permanent du Conseil de s\u00e9curit\u00e9 de l\u2019ONU, a d\u00e9cid\u00e9, \u00ab avec pr\u00e9m\u00e9ditation, de commettre une agression flagrante et des crimes de guerre en lan\u00e7ant une vaste et brutale campagne militaire contre un voisin innocent et sa population civile, sous le faux pr\u00e9texte que l\u2019\u00c9tat vis\u00e9 commettrait un g\u00e9nocide. \u00bb<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;When confronted by such open illegality, is this Court utterly powerless to stop it?\u201d he added.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Professor Hongju Koh stressed the importance of the Court&#8217;s precedent ruling, which should ignite a spark in the efforts of other international institutions dealing with Russian aggression, war crimes, and violations of human rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Selon l\u2019avocat, il s\u2019agit d\u2019un diff\u00e9rend entre la Russie et l\u2019ordre juridique mondial, form\u00e9 apr\u00e8s la 2e Guerre mondiale. L\u2019incapacit\u00e9 de la Cour \u00e0 s\u2019opposer r\u00e9solument \u00e0 la Russie confirmera l\u2019effondrement de l\u2019ordre juridique mondial, ainsi que l\u2019impuissance de l\u2019ONU comme de la Cour internationale de Justice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les arguments avanc\u00e9s par cet avocat \u00e9minent n\u2019\u00e9taient pas uniquement juridiques, mais aussi politiques. Ils ont toutefois port\u00e9. Cela cr\u00e9e \u00e0 son tour un autre pr\u00e9c\u00e9dent. Le 16 mars, la pr\u00e9sidente de la CIJ, Joan Donoghue, a annonc\u00e9 l\u2019ordonnance de la Cour internationale de Justice : \u00ab la F\u00e9d\u00e9ration de Russie doit, dans l\u2019attente de la d\u00e9cision finale en l\u2019affaire, suspendre les op\u00e9rations militaires qu\u2019elle a commenc\u00e9es le 24 f\u00e9vrier 2022 sur le territoire de l\u2019Ukraine. \u00bb<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a><\/a>L\u2019ordonnance de la CIJ servira de point de d\u00e9part \u00e0 l\u2019am\u00e9lioration du fonctionnement concret des juridictions internationales dans les affaires relatives aux crimes commis par la Russie en Ukraine.<\/p>","protected":false},"excerpt":{"rendered":"<p>Ukraine\u2019s truly epic resistance to Russia&#8217;s unprecedented brutal aggression has entered its second month.
